App subscriptions

Scope: These terms supplement the Consumer Terms for automatically renewing subscriptions offered by Patrick Irmler, trading as DEEPBURG Digital Science, within a Deepburg app through Google Play. Where an entrepreneur subscribes solely for a trade or profession, the Business Terms also apply. Mandatory consumer law remains unaffected.
1. Provider and contact
The provider of the app features made available through the subscription is Patrick Irmler, sole proprietor trading as DEEPBURG Digital Science, Bessemerstraße 51, 12103 Berlin, Germany; email: mail@deepburg.com; telephone: +49 30 23327288.
2. Transaction-specific information and priority
Before the user places a paid order, the Google Play purchase flow for the selected subscription displays in particular the included features or content, total price including applicable taxes, billing period, any minimum commitment, automatic renewal, technical requirements and any trial or introductory price. This transaction-specific information prevails over these general terms in the event of a conflict. Users must not be required to search outside the purchase flow for material pricing or renewal information.
3. Contract formation and Google Play’s role
The contract is formed only when the user confirms the clearly labelled paid order in the Google Play purchase flow and Google Play displays successful completion. Google Play provides the store and billing interface and processes payment under the Google Play terms applicable to the user’s country and account. Google’s precise billing and tax role may vary by territory. Deepburg remains the provider of the promised app features and the contact for conformity and product support.
4. Subscription service and recurring value
During its term, the subscription provides access to the continuing or recurring digital features, content or services clearly described in the relevant offer. A subscription is not used for a solely one-off benefit. The offer specifies the included app, accounts, devices, platforms, storage or usage allowances. Additional products not identified as included are not owed.
5. Price, billing and automatic renewal
The price, currency, billing period and payment time are those displayed in the Google Play billing interface immediately before the order. The subscription renews for the period stated there unless cancelled before the next renewal time. Uninstalling the app or deleting a local app profile does not cancel the Google Play subscription. Price changes follow the applicable Google Play procedures and law; any required consent or cancellation right remains unaffected.
6. Free trials and introductory offers
Where a trial or introductory price is offered, its duration, eligibility, scope, conversion date, subsequent price and cancellation route are displayed before the order. Unless cancelled in time, the offer converts on the stated date into the paid subscription identified there. Eligibility may be limited per user or Google account where the offer clearly discloses that restriction.
7. Provision, compatibility and availability
Access is generally enabled through the Google account used for the confirmed purchase. Supported operating-system versions, devices, internet or account requirements and material restrictions are described in the app or store listing. Maintenance, security measures or events outside Deepburg’s control may temporarily affect use. Statutory rights for failure to supply or lack of conformity remain available.
8. Updates and security
For the period required by contract and law, Deepburg supplies and notifies users of updates, including security updates required to maintain conformity. Users install supplied updates within a reasonable time and follow reasonable installation instructions. Statutory rights are restricted only where the applicable legal requirements are met.
9. Changes to features or content
Beyond changes required to maintain conformity, Deepburg may change a continuously supplied app service only for a valid reason provided by the contract, without additional cost and with clear information. Valid reasons may include necessary responses to security risks, mandatory law, store or operating-system requirements or technical dependencies. Where a change materially impairs access or use, Deepburg gives advance notice on a durable medium and preserves the rights required by Section 327r BGB.
10. Managing and cancelling a subscription
The relevant app provides an easily accessible online route in its account, settings or help area to manage or cancel the subscription. For Google Play billing it leads to Manage subscriptions in Google Play. Unless the purchase offer states otherwise, cancellation stops automatic renewal and access continues until the end of the paid billing period. Mandatory rights to immediate termination or a pro-rated refund remain unaffected.
11. Right of withdrawal
Before contract formation, consumers receive the withdrawal information applicable to the specific subscription, including the model form and information about any legally required electronic withdrawal function. Cancellation and withdrawal are different: cancellation generally stops future renewal, while withdrawal reverses the contract where the statutory conditions are met. See the Right of Withdrawal. Any consent to immediate performance and acknowledgement of possible consequences are obtained separately and are not preselected where required.
12. Refunds and statutory remedies
Refund requests may be handled through the routes offered by Google Play. Independently, mandatory statutory rights remain available against Deepburg, in particular for failure to supply or lack of conformity of the digital product. Where the statutory conditions are met, remedies may include cure, termination or price reduction and damages or reimbursement of expenses. Google Play procedures do not shorten these rights.
13. User account and acceptable use
Credentials must not be shared abusively or used to circumvent usage, security or billing limits. Deepburg may take necessary and proportionate protective measures in response to a concrete security risk or material breach. Before a permanent suspension, the user is normally informed and given a reasonable opportunity to remedy the issue unless urgent security, abuse prevention or mandatory law prevents this. Statutory rights remain unaffected.
14. Privacy and end of subscription
Each published app provides an app-specific privacy policy tailored to its actual processing and easily accessible before and within the app. It describes in particular Google Play purchase data, accounts, device or push information, backend and support data, recipients, retention periods and deletion options to the extent those activities occur. After the subscription ends, continued account access, data export and deletion follow the specific service description, app privacy policy and statutory retention duties.
15. Minors
A paid subscription may be purchased only by an adult with legal capacity or with the required consent of a legal representative. Apps directed at children are additionally subject to applicable youth, data and platform protections; the specific age rating and target audience are stated in the store listing.
16. Support, law and language
Product support is available at mail@deepburg.com. German law applies without depriving consumers habitually resident elsewhere of mandatory protections of their country of residence. No exclusive venue is agreed for consumers. The German version governs subscriptions offered in Germany; in other markets legally required information is provided in a language the user can understand.
